Terms of service for Loudcheck

Acceptance of these terms

By visiting the site, creating an account, or otherwise using Loudcheck, you agree to these terms. If you do not agree, please do not use the service. The signup flow requires an explicit acknowledgement of these terms so we are both on the same page from the first interaction.

Permitted use

You may use Loudcheckto learn what is being said about the names, products, or handles you have asked us to monitor — and to act on that information in your own business. You agree not to do any of the following:

• Reverse-engineer or scrape the brief. Automated retrieval of the brief, its delivery API, or its underlying pipeline in order to reconstruct the service or resell it under another name is not allowed.
• Automate sign-ups or keyword farming. Creating accounts, registering keywords, or generating activity programmatically — including signing up other people without their consent — is not allowed.
• Resell or redistribute the brief. The brief is delivered for your own use. You may not republish it wholesale, syndicate it, package it, or offer it as part of a competing product.
• Use it to stalk, harass, or dox. Tracked mentions exist to inform your work, not to enable coordinated campaigns against individuals. Using Loudcheck to identify, contact, or pressurise a private person is not allowed.

The brief content & intellectual property

The weekly brief — its text, structure, and curation — is owned by Loudcheck. The underlying source mentions excerpted or summarised in the brief are third-party public content referenced for your benefit; their original publishers retain whatever rights they hold, and Loudcheck claims no ownership over them.

When you subscribe, you receive a non-exclusive, non-transferable license to read the brief and act on what is in it for your own business use. You may quote short excerpts from the brief in your own commentary, provided the excerpt is attributed to Loudcheck and is not used in a way that suggests Loudcheck endorses what you are saying.

You may not:

• Republish the full brief, or a substantial portion of it, on another site.
• Resell, sublicense, or bundle the brief — in whole or in part — as a product or service of your own.
• Use the brief, or material derived from it, as training data for a competing product.

Data you provide to Loudcheck (your tracked keywords, brand handles, and the email you sign up with) is yours. Submitting it to the service does not transfer ownership of that data to Loudcheck; the rules governing how we handle it are set out in /privacy.

No professional advice

The brief is informational and editorial. It is not legal advice, financial advice, medical advice, or any other kind of professional advice, and it is not a substitute for advice from a qualified professional in the relevant field. You are responsible for the decisions you make based on it, including any actions you take toward third parties named in a tracked mention.

Liability and warranties

The service is provided "as is" and "as available", without warranties of any kind — express, implied, or statutory — including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Loudcheck does not warrant that the brief will be uninterrupted, error-free, or complete.

To the maximum extent permitted by law, Loudcheck’s aggregate liability to you for any claim arising out of or relating to the service is limited to the greater of (a) the amount you actually paid Loudcheck in the twelve months preceding the event giving rise to the claim and (b) one hundred US dollars. If you use the service on a free tier, Loudcheck’s aggregate liability is limited to one hundred US dollars. In either case, Loudcheck is not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, goodwill, or data.

Nothing in these terms is intended to exclude or limit any right or remedy you have under mandatory applicable law that cannot be excluded or limited by agreement.

Abuse and consequences

Loudcheckis small and built on trust. Subscribers who use the service to harm others — or to harm the service — are asked to stop. Examples of conduct that we treat as abuse include:

• Credential stuffing or account takeover. Attempting to sign in to an account that is not yours.
• Scraping the brief.Automated or bulk retrieval of brief content — including via the email delivery channel — beyond the normal recipient access the subscriptions are designed for.
• Overwhelming the pipeline. Registering keywords, accounts, or activity at a rate designed to overload our agents or starve other subscribers of capacity, rather than to use the service legitimately.
• Deliberately polluting others' briefs. Submitting false keyword registrations or seeding false sources in order to put inaccurate, defamatory, or otherwise harmful content in another subscriber's brief.
• Faking accounts at scale.Automated creation of fake accounts — whether to amplify content, influence ranking, or evade enforcement.

Where we have a reasonable belief that abuse is happening, we may investigate, suspend access without prior notice, terminate the account, refuse paid refunds where abuse is established, and, where warranted, cooperate with law enforcement or affected third parties. We try to apply these steps proportionally; we do not promise notice in advance where giving notice would defeat the point of the action.

Changes to these terms

We may update these terms as the service evolves. For material changes — anything that meaningfully affects your rights or obligations — we will notify active subscribers by email at least fourteen days before the new terms take effect. The “Last updated” date at the top of this page will also be updated. Continued use of Loudcheck after the effective date of a change constitutes acceptance of the new terms. If you do not agree to a change, you may close your account before the effective date; you can always email us at loudcheck@polsia.app with questions about a planned change.
